Paramount Girl Sues Over Accident at Raging Waters

Raging Waters amusement park was accused of negligence Tuesday in a lawsuit filed on behalf of a 17-year-old Paramount girl paralyzed when her float tube collided with a man at the park's "Raging Rivers" ride.

Rocio Estrada, a senior at Paramount High School, suffered a broken neck in the accident Aug. 17 at the park in San Dimas, said her attorney, James Fox.

Fox said Rocio's uncle lost control of his tube and it was swept away in the current. Despite signs warning him not to do so, the uncle began walking down a spillway to retrieve the tube, the lawyer said. The lawsuit, filed in Los Angeles Superior Court, said the current swept Rocio, in her tube, "down the spillway, sliding into her uncle's legs, causing him to fall on top of her, causing a broken neck and a spinal cord injury."

Officials at Raging Waters were not immediately available for comment on the lawsuit.

Rocio is undergoing treatment at the Rancho Los Amigos rehabilitation center in Downey.

The lawsuit said the Raging Rivers ride was "unreasonably dangerous and negligently operated." The ride has been shut down since the accident, Fox said.

Filing a lawsuit? Oh Please.
If you go by what the article states, the Uncle flagrantly put himself in harms way be ignoring posted signs. The result of his negligence was injuring his niece.

While I have tremendous compassion for the girl being injured, I see in now way how it is Raging Waters fault. But hey.... I'm no lawyer and there may be other circumstances.

Yeah, from the little the article said, it sounds like her uncle screwed up. It sucks, I know, but most of us know we're not entitled to millions just because we got paralyzed. Nevertheless, he'll probably win a fat settlement out-of-court, and the park will not admit any negligence. It sounds like it was just a tragic accident that may have been avoidable on her uncle's part. Sometimes life sucks--but I don't have to tell any of you that.

Here's to hoping she gets a full recovery...

I hate these lawsuits that blame everyone but the person involved. She is clearly going after the amusement park because that is where the money is, but it is her uncle who broke the rules. There is risk in everything. She took it, she lost. End of story. I hope it gets thrown out of court.
