ADA workplace discrimination and harassment
it look like i may need help with returning to work with ADA accommodations and legal action concerning a new injury that occurred when i was assigned work outside my permanent restrictions. i was accommodated for over 1 year when i returned to work after my initial injury( on the job accident) local management changed and a pattern of harassment and work assignments outside my restrictions developed. my previous held accommodations were denied .
i have work for 24 years for one of the biggest telecommunications corporations in the USA. this recent action is also age discrimination since i am eligible for early retirement with full medical benefits next year. |

Did you bring it up with the CWA? If it is a local group issue, maybe transfer to a different one? Can you change job title to something else? Just what are they doing?

I am a member of Iue-CWA there attorney" in Washington, we went to the top" is the one who told me this, that they can still get around it by saying ,they have no job for you, But they have to make "reasonable accomodation's" if they can show it's going to put a undue hardship on them, I'm not 100 percent sure, but they may be able to get out of it. But if it's a on the job injury there should be a way to make them accomodate you!! any way Good luck and let us know how you come out!! Doug T-12 incomplete 10-3-02 |

Get all these decisions and discussions with your employer/supervisor/HR department in writing (if by e-mail, I hope you kept them).
Find an attorney who does both labor and ADA law. You can get a referral from your local bar association, or call your local ILC as they may also know attorney's practicing in this area. Since you are in NY, I would also try calling the office for United Spinal Association (formerly the EPVA) as they have a lot of attorney contacts. Deal with this immediately.
Two courses ofaction: 1. Contact DRA - Disability Rights Advocates They are the best in the country at impact litigation and this might be just that. And they do national cases. When you call them ask to speak with Larry Paradis and that you were referred to him by Larry Watson - the former executive director at CIL. Larry was just named one of the top 32 attorneys in California in March, 2004. The guy is in a chair himself and is awesome. 2. If DRA won't take your case get a referral from Larry. Last, but not least, if DRA can't help . . . jump on Martindale Hubbel's website (do asearch on Yahoo). At the MH website you are looking for a labor and ADA attorney rated AV. Good luck. I am wondering if Verizon is anything like SBC...Is there some sort of 'accomodations manager/director' somewhere in the company that you could bring the issues to? At SBC that person is an actual RN that is on staff filling that position and is really good. Something to check into.
