Well they switched sci advocates on me. And then quotes are back at my DME so good new about the qoute bad news about my advocate. Now the new advocate needs to some how get up to speed on my case and chair status. Wish me luck

This is, indeed, how Medicare is supposed to function. Some DME's charge 20% of the invoice, rather than the legally mandated Medicare assignment amount.

Update on whats up. Well the DME is dragging thier feet and tried to get me to get a different chair because they don't want to become a dealer for icon. Witch is fine in freekin dandy. I could give a crap less if they become a dealer. I am not playing their games. So my advocate is getting really upset with the DME. Not only because they want to play games but because they are not working on getting me the icon.. they haven't even submitted the claim over to the insurance. Everything has been done. All they need to do is submit the claim. Or auth. Either way its old and i hate this dme. I requested my insurance let me go to a new DME. We will see what happens.

This only holds true is your DME accepts assignment from Medicare--there is no mandate that a DME company accept assignment.

It certainly is true that a DME not enrolled in Medicare, or one that is enrolled but status 'nonparticipating', can charge whatever they want (former) or pass on more cost to the patient (latter).

However, if one has Medicare as primary, there would be no sense in using a DME that doesn't participate in Medicare.
