    Canadian Pro-Life Group Seeks Asylum for Terri Schiavo

    Washington, DC (LifeNews.com) -- A pro-life group headed by a leading disability rights advocate is asking the Canadian government to offer asylum to Terri Schiavo, who is scheduled to be removed from a feeding tube on Wednesday that is keeping her alive.

    Human Life Matters has asked Canadian Immigration Minister Denis Coderre to grant Terri an emergency asylum in the country.

    "Death by starvation is unthinkable," said Mark Pickup, the group's founder.

    Pickup has been profoundly disabled from severe multiple sclerosis, though he continues to travel North America advocating for those who are disabled and dealing with reduced medical care or familial support.

    "It was the most blatant and brutal case of anti-disability discrimination ... that I had ever come across," Pickup told the Edmonton Sun newspaper about Terri's case and her parents efforts to help. "They were doing no more than I would do if it was my daughter in that position, so I said we'd try to help."

    Human Life Matters has obtained the help of David Kilgour, a member of the Canadian parliament from Edmonton. He wrote Coderre requesting asylum for Terri.
    Even if the Canadian government granted the asylum request, it is unlikely that Terri Schiavo could take advantage of the offer. As Terri's guardian, Michael Schiavo would likely decide whether Terri would go to Canada or stay at the Clearwater, Florida hospice facility where she is currently living.

    Given Michael's refusal to allow rehabilitative care or Terri or for her to learn to eat and drink on her own before the gastric tube is removed, it is doubtful that Michael would consent to Terri's transfer.

    Though the chances of success are minimal, but Pickup says his group is hoping for the best.

    "There are a hundred reasons why it shouldn't be done -- all bureaucratic and legal reasons -- and only one reason why it should be done," the Sun newspaper quoted Pickup as saying. "And that's because it's the right thing to do."

    Pickup said that when he spoke to Bob Schindler this weekend, "his comment to me was maybe the asylum offer is our only option now."

    Sheila Zetter, a member of Human Life Matters' board of directors is a respiratory therapist said several local doctors and therapists have volunteered to provide medical care for Terri should she be granted asylum and they will also find her a quality hospice care facility where she could live.

    Other States Rulings in similar cases:

    * In 2001, the California Supreme Court ruled that food and water should not be kept from a patient who is mentally incompetent but may still be conscious. In the case of Robert Wendland, 49, of Stockton, his wife wanted a feeding tube removed, but his mother argued that her son would want to live. Medical experts differed as to his level of consciousness. The court found the evidence was not "clear and convincing" that Wendland would have wanted the tube removed. He died before the court ruled.

    * In 1995, the Michigan Supreme Court refused to allow the removal of Michael Martin's feeding tube. His wife had argued that Martin never wanted to live via artificial means. His mother and sister opposed the wife's wishes. His feeding tube was continued.

    Gov. Bush to Seek Legal Options to Intervene for Terri Schiavo

    Clearwater, FL (LifeNews.com) -- Governor Jeb Bush, who has been rebuffed by the courts after previous attempts to help Terri Schiavo, has instructed his legal team to look for an 11th hour way to stop the removal of her feeding tube that is scheduled for Wednesday afternoon.

    Bush met with Bob and Mary Schindler, Terri's parents, for 20 minutes this morning. He said staff attorneys are looking for some way to block the feeding tube's removal though he doesn't know what options may exist.

    "We are going to seek whatever legal alternatives are available and seek the best minds to find another avenue to submit to the courts to see if there can be a change in this ruling," Bush said to reporters Wednesday morning.

    "I am not a doctor, I am not a lawyer, But I know that if a person can be able to sustain life without life support, that should be tried," the governor said according to news reports.

    Although the gastric tube provides Terri with food and water, she is not currently on artificial life support and is able to breath entirely on her own.

    Bob Schindler, Terri's brother, told the Associated Press he was delighted that Bush is trying to step in last minute to prevent Terri's death.

    "The family has not given up hope on Terri," Schindler said after the meeting with Bush. "We have spoken to the governor, and he hasn't given up hope either."

    Previously, Bush submitted an amicus brief on Terri's behalf in an appeal the Schindlers filed in federal court recently. The court denied their motions to allow Terri to eat and drink on her own and to remove Circuit Court Judge George Greer from the case. Greer ordered the removal of the feeding tube.

    A Florida appeals court on Tuesday gave the final stamp of approval for the removal of the feeding tube that is allowing Terri Schiavo to live.

    Michael Schiavo's attorney George Felos, an assisted suicide advocate, said, following the decision, "It certainly appears the legal options for the Schindlers are diminishing very quickly."

    Terri Schindler Schiavo laughs and cries in her hospital bed. The 39-year-old Florida woman smiles warmly and responds lovingly to family and friends. Able to indicate yes and no despite her disability, she clearly communicates she does not want to be starved to death.

    Terri Schindler Schiavo, a disabled young woman in Florida, will be starved to death beginning Oct. 15 at the demand of her husband, Michael, who stands to gain financially from her death.

    There is clear medical evidence that Terri is able to communicate and respond to commands. What's more, 13 physicians have stated that Terri can recover significantly with proper therapy. Her husband, however, has denied her this therapy and has seen to it that she receives only basic comfort care. He already is living with and had a child with another woman, even though he is legally married to Terri. There also is medical evidence of the potential foul play may have caused her brain damage.

    Therefore, I urge you to intervene in the case and stop Terri Schindler Schiavo from being starved and dehydrated to death. Please give her time for a full investigation into how her brain damage occurred and how it can be overcome. I ask you to do everything in the power of your office to stand up for this woman who cannot defend herself.

    As you know, Terri suffered a collapse in 1990 during which she was deprived of oxygen for several minutes, causing her brain injury. She receives nutrition and hydration by a feeding tube, but is receiving no other life-support measures. Her husband has permission from Florida courts to remove her feeding tube, even though numerous physicians say Terri can recover with proper therapy, which has been prevented by Michael.

    Terri's family believes the courts, especially Judge George Greer of Pinellas, have shown extreme bias favoring Michael Schiavo's desire to see his wife die. Though video evidence has been submitted of Terri responding to doctors and family members, Judge Greer ruled those responses reflexive and "inconsistent."

    It originally was thought Terri's condition resulted from a heart attack -- until recently when a doctor other than those physicians selected by Michael was allowed to review her medical records. This doctor found Terri's collapse wasn't due to a heart attack. Instead, he said it is possible Terri is a victim of strangulation.     Fla. Doctors Remove Woman's Feeding Tube

    PINELLAS PARK, Fla. - The feeding tube keeping a severely brain-damaged woman alive was removed Wednesday, all but ending an epic, 10-year legal battle between her husband and her parents.

    Terri Schiavo, 39, had the tube removed at the Tampa Bay-area hospice where she has lived for several years, said her father, Bob Schindler. Attorneys representing her husband, Michael Schiavo, said it will take between a week and 10 days for her to die.


    The parents want Terri Schiavo to live, and her husband says she would rather die. She has been in a vegetative state since 1990, when her heart stopped because of what doctors said may have been a chemical imbalance.


    Bob Schindler said he and his wife, Mary, went in to see their daughter shortly after the tube was removed and gave her a kiss and hugged her. He said his daughter was not as responsive as they claim she normally has been.


    "She's OK for the next couple of days," said Suzanne Carr, Terri Schiavo's sister. "We are just going to try to work some magic."


    "I have to believe that somebody is doing something, somewhere to stop this judicial homicide," she said.


    Michael Schiavo and his attorney George Felos were not immediately available for comment after the removal of the tube.


    Several right-to-die cases across the nation have been fought in the courts in recent years, but few, if any, have been this drawn-out and bitter. The tangled case has already been handled by 19 separate judges and the tube has been ordered removed three times. At one point 2001, the tube was removed for two days before a judge ordered feeding to be resumed based on new evidence.


    About 100 protesters stood outside the hospice Wednesday in what has become a 24-hour vigil staged by advocates for the disabled and anti-abortion activists.


    Wednesday's removal came just hours after Gov. Jeb Bush told the Schindlers that he was instructing his legal staff to find some means to block a court order allowing Michael Schiavo to end his wife's life. But even the family's lawyer has said their legal remedies have been exhausted.


    "I am not a doctor, I am not a lawyer. But I know that if a person can be able to sustain life without life support, that should be tried," the governor said, adding the "ultimate decision of this is in the courts."


    Family members held out hope that they could save her life and were heartened by the governor's last-minute effort.


    "The family has not given up hope on Terri," the woman's brother, Bob Schindler Jr., said following a meeting with Bush. "We have spoken to the governor, and he hasn't given up hope either."


    Schiavo's family members believe she is capable of learning how to eat and drink on her own and say she has shown signs of trying to communicate and could be rehabilitated.


    Michael Schiavo says he is carrying out his wife's wishes that she not be kept alive artificially.


    Felos has said that the Schindlers were "still in denial" over Terri Schiavo's wishes not to be kept alive with the tube, an IV-like device that pumps food and water into her stomach.


    Doctors have testified that the noises and facial expressions Terri Schiavo makes are reflexes and do not indicate that she has enough mental capabilities to communicate with others.





    The Florida Supreme Court (news - web sites) has twice refused to hear the case, and it also has been rejected for review by the U.S. Supreme Court (news - web sites). On Tuesday, a Florida appeals court again refused to block removal of the tube.

    The Schindlers first sought to remove Michael Schiavo as his wife's guardian in 1993 after a falling out over her medical care. They say he now has a conflict of interest because he is engaged to another woman and they have a child together.

    The family has also leveled allegations that Michael Schiavo has abused Terri Schiavo, although the accusations have not been substantiated.

    Among other things, the parents allege that Michael Schiavo exploited his wife by using money awarded to her in a malpractice lawsuit to pay attorneys fees rather than for therapy. The father had said the couple had not made a formal complaint to the state Department of Children & Families but might file a last-minute one.

    We've seen the video of this woman (on the news) with her mother. She has expression in her eyes. She seems to react to her mother in the video. I don't see how they can be so sure that she is not aware to some degree. If she were brain dead, surely she would not have expressions like she does of being happy when her mother is there with her.
