Brad (tigger74) and I were in an accident last Wednesday, April 16, on our way home from Brad's appointment for his yearly exam with his spinal cord Dr..The accident occurred several miles north of Clinton. Some large equipment was being moved and there were two cop cars off on the side of the road with their lights on to slow traffic down. A truck slammed into the car that hit us and we bumped the truck in front of us. There was no sound of breaking from the truck that started the collision. All the vehicles were at a stand still, Brad had his widow down, but neither he or I heard any sound except the impact. The impact was so intense, that the back of Brad’s wheelchair ripped on the right side below the handle half way down the back. So, with Brad not being able to sit up in the wheelchair he was unable to press the break and had to get me to take the hand control and press the break to stop the van from going accross the road and down the ravine. Good thing I got the break and didn't accelerate or we would have been down a deep valley! Brad sat in his wheelchair without the back support for approximately 45-50 minuets long. Brad was driving so his wheelchair was locked in the driver’s position with the EZlock. I was so worried about Brad and getting all the valuable stuff together I didn't realize my back was hurting, but as soon as I stepped out of the van to talk to the police officer, I realized my back was hurt. Immediately I got placed on a stretcher board and put in the ambulance, then finally, after over 45-50 minuets of stress to Brad’s back, he was put in the same ambulance as me and we were taken to the ER. Do to the back of the wheelchair being ripped, it provided him with no support, causing stress to his right hip joint. Brad had x-rays taken of his lower spinal chord and his hips. I also had X-rays taken of my back. There were also 2 cuts on Brad's right knee and another cut on his left shin that didn't get taken care of, so of course the little "Miss Perfect" Brad is always teasing me about being I cleaned them up and put bandaids on them, and then we went to bed at about 11:30p.m.. We didn't wake up till about 3:00p.m. the next day.

I'm still pretty sore in my Neck, Shoulder and Right hip. My Dr. wants me to have a full Hip replacement on my right side now. He also wants me to get a baclofen pump before his does the Hip Replacement. My van was total in the accident. We was rearend in a chain reaction wreck. The guys at the insurace company doesn't want to pay for anything. There was also 4 others hurt in the accident. The insurace agent said ''They would have to split the money up between all that was involved in the accident and see what was left after that.'' That just not right. I've missed so much work and other activites that I do. Has anyone else had wreck that was caused by someone else since being hurt? I need my van back.

Get a lawyer pronto!!! Insurance companies try this all the time (splitting the money...HA!) Find a good attorney fast, and do not talk to the insurance companies first. They do not want to pay any more than they have to and they do not have to disclose the rules of battle to you either. It was not your fault and you should be fully reimbursed and any medical costs covered in full. If you have to sue to get your costs covered and everything else, you have to be first in line. Do not delay.

I'm glad to hear you're OK, but what skippy said - get an attorney muy pronto! The insurance company's trying to weasel its way out, when they need to shut up and pay up for everyone who got hurt, including you. I've learned over the years that all insurance is, whether health, unemployment, or auto, is just a legalized extortion racket. You gotta pin 'em down and hold 'em to their end of the coverage. Was the DOT involved in this (I'm guessing yes, construction zone and all that)? That highway is bad enough what with all the truck traffic it has :(

Brad's back, neck and shoulder are still hurting, he is also having alot of autonomic dysreflexia, sweating so bad at night it is soaking his pillow. He is really having a hard time with the pain, he has not been sleeping very well at night, not only because of pain, but worries about everything:zombie: such as work, bills and law suit. I have been keeping a journal and writting everything down, from the accident. I wrote everything starting with accident and continuing on with all the day to day pain and pain killers he and I have been taking. I am having really bad headaches every evening, but that does not worry me as much as Brad's hip pain and his new right arm/shoulder really hurting and spasming. Oh yeah, he also has this new spasm in his stomach, for the first few minuets when he gets into his chair. I'm also very worried about the Baclofen pump, I know he really does not want to get one and with the amount of pain and spasms he is having he is getting a little more at ease about having one put in. Allthough, you can see in his eyes how unsure about jumping off that ledge he is. I talked to the Dr. about his apprehension about the prosses and the Dr. told me and Brad that, that was the only thing he could do to help his spasms. I'm just not completely sure of that. I've been doing some research and happen upon a little information on Calcium Channels I'm just not sure if he shouldn't try a different Calcium Channel blocker, being that it has been 11 yrs, his body may have adjusted to the Baclofen. I know he doesn't want the pump, because of the "hocky puck" in his stomach as he calls it. I told him who really cares what it looks like, as long as it improves the quality of his life. Does anyone have any suggestions or coments on this proceedure?
