N.Y. State Appeals Court Reverses $8.9 Million Award of Man Paralyzed by Police After Being Shot by an Officer

N E W Â* Y O R K, July 12 - A state appeals court has overturned a $8.9 million verdict won by man paralyzed from the waist down after being shot by a police officer.

The court ordered a new trial Thursday after finding the judge erroneously excluded evidence that the victim was a member of a group that advocates the killing of police officers.

Darryl Barnes was shot in the back on a Bronx street by Officer Franz Jerome in 1988. The city argued that Barnes was reaching for his gun.

Barnes, now 37, said he had dropped the gun and put up his hands when Jerome shot him point blank, severing his spine.

A jury awarded Barnes $76.4 million, later reduced by the judge to $8.9 million.
The judge had excluded evidence that Barnes was a member of a police-hating group, saying there was no indication the police officer knew that.
